These Terms and Conditions (these “Terms”) apply to your access to and use of the websites, mobile applications, and services of One Tribe Tours (“One Tribe Tours,” “we,” “us,” or “our”), including any purchase of tickets, passes, or booking of reservations to participate in any tour, retreat, or activity arranged, led, promoted, and/or sponsored by One Tribe Tours (collectively, “Tours,” “Retreats,” or “One Tribe Tours Activities”).

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, INCLUDING BINDING ARBITRATION AND CLASS ACTION WAIVER PROVISIONS.

BY ACCESSING OUR WEBSITE, MAKING A PURCHASE, OR PARTICIPATING IN OUR TOURS OR RETREATS, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE OUR SERVICES OR PARTICIPATE IN OUR TOURS OR RETREATS.

1. Agreement to Terms

By using our website or services, you represent and warrant that:

  • You are at least 18 years of age and have the legal capacity to enter into this agreement
  • All information you provide is true, accurate, and complete
  • You will comply with all applicable laws and regulations

2. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be announced on our website. Your continued use of our services after such changes constitutes acceptance of the revised Terms. If you do not accept revised Terms, you must discontinue use of our services.

3. Booking Information

To book Tours or Retreats, you will need to provide contact and payment information. You agree to:

  • Provide accurate and complete booking information
  • Promptly update your information if it changes
  • Accept responsibility for all bookings made using your contact information

We reserve the right to refuse or cancel bookings that contain false, misleading, or incomplete information.

4. Booking and Purchases

Payment Terms

  • All prices are subject to change without notice
  • Payment must be received before confirmation of your booking
  • You must be 18 years or older to make purchases
  • You represent that payment information provided is accurate and authorized

Tickets and Passes

  • Tickets and passes are valid only for the dates and times shown
  • All bookings are non-refundable unless cancelled according to our cancellation policy below
  • Tickets and passes are non-transferable unless otherwise approved by One Tribe Tours
  • Unauthorized resale or transfer of tickets is prohibited
  • We reserve the right to refuse admission or revoke tickets without refund for violation of these Terms

Cancellations and Modifications

  • Guest Cancellations:
    • Cancellations made 7 days or more before your scheduled tour or retreat will receive a 100% refund
    • Cancellations made less than 7 days before your scheduled tour or retreat will receive no refund
  • Weather or Safety Cancellations: Tours or retreats cancelled by One Tribe Tours due to weather, unsafe conditions, or other circumstances beyond our control will receive a 100% refund
  • Minor Schedule Changes: We reserve the right to make minor alterations to tour or retreat times with reasonable advance notice

5. Guest Conduct and Safety

General Conduct Requirements

All guests must:

  • Comply with all posted signs and instructions from One Tribe Tours personnel
  • Behave in a respectful, orderly manner at all times
  • Use only designated entrances, exits, and walkways
  • Wear appropriate attire (no profane, graphic, or obscene clothing)
  • Refrain from threatening, disorderly, harassing, or disruptive behavior

Prohibited Activities

The following are strictly prohibited:

  • Illegal drug use
  • Excessive alcohol consumption or intoxication
  • Commercial photography or videography without prior written consent
  • Soliciting, panhandling, or distributing materials without authorization
  • Vandalism, theft, fighting, or any illegal activity
  • Entering restricted or employee-only areas

Prohibited Items

Guests may not bring:

  • Weapons of any kind (firearms, knives with blades over 3.5 inches, pepper spray, etc.)
  • Explosives, fireworks, or dangerous materials
  • Drones or unmanned aerial vehicles (without prior written approval)
  • Alcoholic beverages
  • Illegal drugs or prescription drugs not properly prescribed to you
  • Glass containers
  • Wheeled recreational devices (skateboards, hoverboards, etc.)
  • Unapproved pets (service animals permitted with restrictions)
  • Any items deemed suspicious, harmful, or disruptive by our staff

Removal and Bans

We reserve the right to deny admission, remove guests, or ban individuals from future Tours or Retreats for:

  • Violation of these Terms
  • Unsafe, illegal, or offensive behavior
  • Failure to follow staff instructions
  • Any reason necessary to ensure safety, security, or order

No refunds will be provided in such circumstances.

6. Health and Safety

Special Conditions

  • Pregnant individuals are not permitted on off-road tours but may be eligible for on-road tours at our discretion
  • All guests and belongings are subject to security searches
  • Service animals must remain on a leash or harness and under owner control at all times
  • Some attractions may not permit service animals due to safety regulations

Assumption of Risk

Participation in Tours and Retreats involves inherent risks. By booking a tour or retreat, you acknowledge and accept:

  • The physical nature and potential dangers of outdoor activities
  • That accidents, injuries, or property damage may occur
  • Full responsibility for your own safety and well-being
  • That One Tribe Tours assumes no liability for accidents or losses during Tours or Retreats

7. COVID-19 and Communicable Diseases

Acknowledgment and Assumption of Risk

By purchasing tickets or participating in Tours or Retreats, you acknowledge and voluntarily assume the risk that you may be exposed to or contract COVID-19, its variants, or other communicable diseases. You understand that:

  • Interaction with the general public poses inherent risks of disease transmission
  • One Tribe Tours cannot guarantee you will not be exposed to infectious diseases
  • You may contract diseases and experience associated health complications
  • You may transmit diseases to others, even without showing symptoms

Release of Liability

You, on behalf of yourself and your family members, hereby release, discharge, and agree not to sue One Tribe Tours and its affiliates, officers, directors, employees, and agents from any and all claims related to exposure to or contraction of communicable diseases during Tours or Retreats, including claims arising from:

  • The negligence of One Tribe Tours or its staff
  • Inherent risks associated with Tours or Retreats during epidemics or pandemics

This release extends to claims by any individual using tickets you purchased, including minor children and family members.

8. Intellectual Property Rights

Our Content

All content on our website and materials, including text, graphics, logos, images, videos, and software (collectively, “Content”), are owned by One Tribe Tours or our licensors and protected by copyright and trademark laws. You may not:

  • Copy, reproduce, modify, or create derivative works from our Content
  • Distribute, transmit, or publish our Content without written permission
  • Use our trademarks, service marks, or logos without authorization
  • Remove copyright or proprietary notices from our Content

User Content

Any content you submit to us (reviews, photos, comments, etc.) grants One Tribe Tours a perpetual, royalty-free, worldwide license to use, reproduce, modify, display, and distribute such content for any purpose without compensation to you.

Photography and Recording

By purchasing tickets or participating in Tours or Retreats, you grant One Tribe Tours the unrestricted right to photograph, film, video record, and take sound recordings of you on our properties or during any One Tribe Tours Activities. These recordings may be used for any purpose, including marketing, promotional, advertising, and commercial purposes, without any payment, compensation, or further consent from you. This grant includes the right to use your image and likeness in any media format now known or later developed.

9. Privacy

Your personal information is collected and processed according to our Privacy Policy. By using our services, you consent to such collection and processing.

10. Third-Party Links

Our website may contain links to third-party websites. We are not responsible for:

  • The content, accuracy, or practices of third-party sites
  • Any transactions or interactions you have with third parties
  • Privacy policies of third-party sites

You access third-party sites at your own risk.

11. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW:

Our services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • That services will be uninterrupted, timely, secure, or error-free
  • That content or information will be accurate, complete, or reliable
  • That defects will be corrected

We do not guarantee tour or retreat availability, weather conditions, or that Tours or Retreats will meet your expectations.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

One Tribe Tours and its officers, directors, employees, and agents shall not be liable for:

  • Indirect, incidental, special, consequential, punitive, or exemplary damages
  • Lost profits, data, or business opportunities
  • Personal injury, property damage, or death (except as caused by our gross negligence or willful misconduct)
  • Any damages exceeding the amount you paid for the applicable Tour or Retreat

Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless One Tribe Tours and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

  • Your violation of these Terms
  • Your violation of any laws or regulations
  • Your violation of any third-party rights
  • Your use of our services or participation in Tours or Retreats

14. Dispute Resolution and Arbitration

Binding Arbitration

YOU AND ONE TRIBE TOURS AGREE THAT ANY DISPUTE ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES WILL BE RESOLVED THROUGH BINDING ARBITRATION, NOT IN COURT.

  • All disputes shall be resolved by binding arbitration under the American Arbitration Association’s (AAA) Commercial Arbitration Rules
  • Arbitration will take place in Yavapai County, Arizona, USA
  • The arbitrator’s decision is final and binding
  • Judgment on the award may be entered in any court with jurisdiction

No Class Actions

YOU AGREE TO PURSUE CLAIMS ONLY ON AN INDIVIDUAL BASIS. You waive any right to participate in class actions, class arbitrations, or representative actions. Disputes will not be consolidated with claims of other parties.

Small Claims Court Option

You may elect to pursue your claim in small claims court instead of arbitration if you provide written notice within 60 days of the dispute arising.

Exceptions

This arbitration provision does not apply to claims that cannot be arbitrated under applicable law.

15. Governing Law

These Terms are governed by the laws of Arizona, without regard to conflict of law principles. Any disputes not subject to arbitration shall be brought exclusively in courts located in Yavapai County, Arizona, and you consent to personal jurisdiction there.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and One Tribe Tours regarding use of our services.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or our right to enforce it later.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control, including natural disasters, wars, pandemics, government actions, or labor disputes.
